235 نُهِينَا عن اتِّبَاعِ الجنائز، ولم يُعْزَمْ علينا
We were forbidden to follow funeral processions, but the prohibition was not mandatory for us

عن أُمِّ عَطِيَّةَ الأنصارية رضي الله عنها قالت: «نُهِينَا عن اتِّبَاعِ الجنائز ولم يُعْزَمْ علينا».

Umm ‘Atiyyah al-Ansāriah (may Allah be pleased with her) reported: We were forbidden to follow funeral processions, but the prohibition was not mandatory for us.

صحيح - ( متفق عليه ). Sahih/Authentic. [Al-Bukhari and Muslim]

أُمُّ عَطِيَّةَ الأنصارية من الصحابيات الجليلات تفيد أن النبي صلى الله عليه وسلم نهى النساء عن اتباع الجنائز؛ لما فيهن من شدة الرقة والرأفة، فليس لديهن صبر الرجال وتحملهم للمصائب؛ فخروجهن يؤدي إلى الهلع والفتنة بما يشاهدن من حال حمل الجنازة والانصراف عنها، ولكن مع هذا فهمت من قرائن الأحوال أن هذا النهي ليس على سبيل العزم والتأكيد؛ فكأنه لا يفيد تحريم ذلك عليهن، والصحيح المنع، وقال ابن دقيق العيد: قد وردت أحاديث أدل على التشديد في اتباع الجنائز أكثر مما يدل عليه هذا الحديث.
A noble female companion, Umm ‘Atiyyah al-Ansāriah, reports that the Prophet (may Allah's peace and blessings be upon him) has forbidden women from accompanying the funeral processions. This is because woman are very delicate and emotional, and are not as patient and enduring as men at times of adversities and calamities. Thus, following the funeral procession will make women panic and distressed as they observe the dead person carried to the grave and left in it. Nevertheless, Umm ‘Attiyyah understood from the surrounding circumstances that this prohibition was not absolute or mandatory, and it does not mean that women are forbidden to do so. But the correct opinion is that women are forbidden to accompany funeral processions. Ibn Daqīq al-Eid said: "There are other Hadīths, which prove strongly prohibition of following funeral processions by women, more than this Hadīth."

قول الصحابي: أمرنا أو نهينا يحمل على أن الآمر والناهي هو النبي -صلى الله عليه وسلم-. نهي النساء عن اتباع الجنائز، وهو عام في اتباعها إلى حيث تجهز ويصلى عليها، وإلى المقبرة حيث تدفن. علة النهي أن النساء لا يطقن مثل هذه المشاهد المحزنة والمواقف المؤثرة؛ فربما ظهر منهن من التسخط والجزع ما ينافي الصبر الواجب. الأصل في النهي التحريم إلا أن أم عطية فهمت من قرينة الحال أن نهيهن عن اتباع الجنائز ليس جازمًا مؤكَّدًا، لكن قد وردت أحاديث أدل على التشديد في اتباع الجنائز أكثر مما يدل عليه هذا الحديث، كما تقدم. نهي الشارع ينقسم إلى عزيمة يلزم اجتناب المنهي عنه، وهو الأصل، وإلى تنزيه يطلب فيه اجتناب المنهي عنه دون إلزام.
