39 إنِّي وَالله- إنْ شَاءَ الله- لا أَحْلِفُ عَلَى يَمِينٍ، فَأَرَى غَيْرَهَا خَيْراً مِنْهَا إلاَّ أَتَيْتُ الَّذِي هُوَ خَيْرٌ، وَتَحَلَّلْتُهَا
By Allah - if Allah wills - if I take an oath to do something and then find something else better than it, I do that which is better and make expiation for breaking the oath.

عن أبي موسى الأشعري رضي الله عنه قَالَ: قَالَ رَسُولُ اللَّهِ - صلى الله عليه وسلم -: «إنّي والله -إنْ شاء الله- لا أَحلف على يمين، فأرى غيرها خيراً منها إلاَّ أَتيتُ الَّذِي هو خير، وتحلَّلْتُهَا».

Abu Mūsa al-Ash‘ari (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "By Allah - if Allah wills - if I take an oath to do something and then find something else better than it, I do that which is better and make expiation for breaking the oath."

صحيح - ( متفق عليه ). Sahih/Authentic. [Al-Bukhari and Muslim]

أنَّ النبي صلى الله عليه وسلم أخبر عن نفسِه بأنَّه إذا حَلَفَ على يَمِينٍ ثم بعد ذلك رأى أنَّ الخيرَ في عدَمِ الاستمرار عليها تَركَها بِتَرك ما حَلَفَ عليه وكفَّرَها التزم الذي هو خير من فعل أو ترك.
The Prophet (may Allah’s peace and blessings be upon him) said about himself that if he swore an oath then saw that it was better not to fulfill it, he would break his oath and make the due expiation. He would always take the better course by doing something or refraining from doing it.

جواز الحَلِفِ من غير اسْتحلافٍ لِتَأْكيد الخبر ولو كان مُسْتَقْبَلاً. جواز الاستثناء بقولِه "إن شاء الله "بعد اليمين. جواز التَّحَلل من اليمين بِعمل الكفَّارة لقوله: "وَتَحَلَّلْتُهَا".
