1519 من حَلَفَ بالأمَانة فليس مِنَّا
He who swears by the 'Amānah' (religious obligations) is not one of us

عن بريدة رضي الله عنه : أن رسول الله صلى الله عليه وسلم قال: «من حَلَفَ بالأمَانة فليس مِنَّا».

Buraydah (may Allah be pleased with him) reported: The Messenger of Allah (may Allah's peace and blessings be upon him) said: "He who swears by the 'Amānah' (religious obligations) is not one of us."

معنى الحديث التحذير من الحلف بالأمانة؛ لأن الحلف بالأمانة حَلِف بغير الله والحلف بغير الله شرك، كما في الحديث: (من حلف بغير الله فقد كَفَر أو أشرك) والمراد بالشرك هنا: الشرك الأصغر؛ والحلف بغير الله لا يخرج من الملة إلا أن يعتقد الحالف أن المحلوف به بمنزلة الله -تبارك وتعالى- في التعظيم والعبادة وما أشبه هذا فيكون شركًا أكبر. والمراد بالأمانة هنا: فرائض الله تعالى من الصلاة والصوم والحج وغير ذلك مما افترضه الله على عباده. فلو قال: بِّحق صلاتي أو بِّحق صيامي أو حجِّي، أو أجْمَل بأن قال: وأمانة الله. فكل ذلك منهي عنه؛ لأن المسلم لا يحلف إلا بالله تعالى أو بصفة من صفاته، وليست الأمانة من صفاته، وإنما هي أَمْرٌ من أمْرِه، وفَرْض من فروضه.
This Hadīth warns against swearing by the 'Amānah', because swearing by other than Allah is polytheism (associating partners with Allah) as mentioned in another Hadīth: "Whoever swears by other than Allah has disbelieved or committed polytheism." 'Polytheism' here means minor polytheism, because the texts indicate that merely swearing by other than Allah does not take a Muslim out of the fold of Islam, except if the one who swears believes that the thing he is swearing by has the same status of Allah, the Almighty, in terms of glorification and worship. If this is the case, then it is major polytheism. 'Amānah' here is a collective term referring to the acts of worship that Allah, the Almighty, has ordained, such as prayer, fasting, Hajj and other religious obligations. If someone says: I swear by my prayer, or by my fasting, or by my Hajj, or generalizes by saying: by Allah's Amānah, then all of this is forbidden, because a Muslim is commanded to swear by Allah, the Almighty, or by one of Allah's attributes. Amānah is not an attribute of Allah; rather, it is one of His commands and ordained religious duties.

تحريم الحلف بغير الله -تعالى-، ومنه: الأمانة. اليمين لا تنعقد إلا بالله -تعالى- أو بصفة من صفاته، وليست منها الأمانة، وإنما هي من أمره؛ فالحلف بها يوهم مساواتها لأسماء الله -تعالى- وصفاته.
