684 خَمسٌ من الدَّوَابِّ كُلُّهُنَّ فَاسِقٌ، يُقْتَلْنَ في الحَرَمِ: الغُرابُ، وَالحِدَأَةُ، وَالعَقْرَبُ، وَالفَأْرَةُ، وَالكَلْبُ العَقُورُ
Five animals are all vicious and harmful and are to be killed (even) inside the Sacred Precincts: the crow, the kite, the scorpion, the mouse, and the mordacious dog

عن عائشة رضي الله عنها أن رسول الله صلى الله عليه وسلم قال: «خمسٌ من الدَّوَابِّ كُلُّهُنَّ فَاسِقٌ، يُقْتَلنَ في الحَرَمِ: الغرابُ، وَالحِدَأَةُ، وَالعَقْرَبُ، وَالفَأْرَةُ، وَالكَلْبُ العَقُورُ». وفي رواية: « يقتل خَمْسٌ فَوَاسِق في الْحِلِّ وَالْحَرَمِ ».

‘Ā'ishah (may Allah be pleased with her) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Five animals are vicious and harmful and are to be killed (even) inside the Sacred Precincts: the crow, the kite, the scorpion, the mouse, and the mordacious dog." Another narration reads: "Five evil things are to be killed inside the Sacred Precincts and outside them."

صحيح - ( متفق عليه. وفي مسلم "الغراب الأبقع" ). Sahih/Authentic. [Al-Bukhari and Muslim]

في هذا الحديث تخبر عائشة رضي الله عنها أن النبي صلى الله عليه وسلم أمر بقتل خمس من الدواب كلهن يتصف بالفسق، سواء في الحِل أو الحرم، ثم بين تلك الخمس بقوله: الغُرابُ والحِدَأَةُ، وَالعَقْرَبُ، وَالفَأْرَةُ، والكلب العَقُورُ. فهذه خمسة أنواع من الحيوانات، وصفت بالفسق، وهو خروجها بطبعها عن سائر الحيوانات، بالتعدي والأذى. ونبه بها معدودة، لاختلاف أذاها، فيلحق بها ماشاكلها في فسقها من سائر الحيوانات، فتقتل لأذيتها واعتدائها، فإن الحرم لا يجيرها والإحرام لا يعيذها.
In this Hadīth ‘Ā'ishah (may Allah be pleased with her) informs us that the Prophet (may Allah's peace and blessings be upon him) ordered the killing of five vicious and harmful animals, whether inside the Sacred Precincts boundaries or outside it, and whether the person is in a state of Ihrām or not. Then he mentioned these five animals: the crow, the kite, the scorpion, the mouse, and the mordacious dog (that which is given to biting). These are five types of animals that were described as vicious for being aggressive and harmful, unlike the rest of the animals. The Prophet (may Allah's peace and blessings be upon him) enumerated them because they differ in the kind of harm they cause, so other animals that resemble them in harm are included, and are to be killed because of their harm and transgression. Their presence inside the Sacred Precincts does not protect them, and the state of Ihrām does not prevent killing them.

مشروعية قتل هذه الدَّوَابُّ الخمسِ في الحِلِّ والحرم، للمُحل والمُحرم. جواز قتل كل ما شابهها في طبعها من الأذية. جواز قتلها ولو كانت صغيرة اعتبارا بمآلها. محاربة الإسلام للأذى والعدوان، حتى في البهائم. كمال التشريع الإسلامي، حيث طلب القضاء على ذوي الفساد والإفساد.
