1981 ألا لا يبيتن رجل عند امرأة ثيب، إلا أن يكون ناكحًا أو ذا محرم
Let no man stay the night in the place of a previously married woman unless he is her husband or her Mahram

عن جابر رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم : «لا يَبِيتَنَّ رجل عند امرأة ثيِّب، إلا أنْ يكون ناكِحًا أو ذا مَحْرَم».

Jābir (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Let no man stay the night in the place of a previously married woman unless he is her husband or her Mahram."

ينهى صلى الله عليه وسلم الرجل عن البيات والمكوث ليلًا عند أي امرأة أجنبية عنه، وخص الثيب؛ لأنها التي يدخل عليها غالبًا، وأما البكر فهي متصونة في العادة مجانبة للرجال أشد مجانبة، ولأنه يعلم بالأولى أنه إذا نهى عن الدخول على الثيب التي يتساهل الناس في الدخول عليها فبالأولى البكر. واستثنى الزوج ومن حرمت عليه بالنسب كالأم والبنت والأخت، أو بالرضاعة، كأمه من الرضاع، أو بالمصاهرة كأم زوجته. ومفهوم قوله (لا يَبِيتَنَّ) غير مراد، وهو أنه يجوز له البقاء عند الأجنبية في النهار خلوة، أو غيرها؛ لأنه جاء في صحيح البخاري نهي عام دون تقييد بالليل. لكن إن كان المحرم لايؤمن فلا بد من وجود نساء مع المرأة.
The Prophet (may Allah's peace and blessings be upon him) forbids staying the night at the place of a woman whom one is not married to, especially that of a woman who has been previously married, for she is often accessible. Virgins, however, avoid men. If men are forbidden access to non-virgins, who are usually accessible, then they are even more so forbidden access to virgins. The exception here applies to one's wife and one's blood relatives, such as his mother; daughter; sister; relatives through fostering, such the suckling mother; and relatives through marriage, such as one's mother-in-law. "Staying the night" does not mean that a man is allowed to stay in seclusion with a non-Mahram woman during the daytime. According to Sahīh Al-Bukhāri, the interdiction is general and not restricted to the night time. If a Mahram, however, is not trustworthy, a non-Mahram woman must be accompanied by other women.

تحريم الخلوة بالأجنبية بالإجماع. يباح خلوة المرأة بالمَحْرم بالإجماع. خطورة الخلوة بالمرأة الأجنبية؛ وإن كان الرجل صالحًا. المرأة مظنة الشهوة والطمع، وهي لا تكاد تقي نفسها؛ لضعفها ونقصها، ولا يغار عليها مثل محارمها، الَّذين يرون النيل منها نيلاً من كرامتهم وشرفهم؛ لذا تحتم وجود المحرم عند حضور الأجنبي. الأصل في المرأة هنا البالغة؛ لكن تشمل المرأة التي تشتهى وإن لم تبلغ. عناية الشرع بالأخلاق.
