عن جابر بن عبد الله رضي الله عنهما قال: (جعل وفي لفظ: قضى) النبي صلى الله عليه وسلم بالشُّفْعة في كل ما لم يقسم، فإذا وقعت الحدود، وصُرِّفَتِ الطرق؛ فلا شفعة). Jābir ibn ‘Abdullāh (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) decreed for partners the right of preemption in property which had not been divided up. However, if the boundaries are demarcated, and the roads are fixed, then there will be no right of preemption."
